Terms and conditions

Lace By CR OÜ, register code 14110927, Raemetsa 1, Reiu küla, 86508 (hereinafter the Seller) and client, in connection with purchasing of the Products from the E-store www.lacebycr.com/shop (hereinafter E-Shop) owned by Lace By CR OÜ and identifies himself/herself by filling out order form with personal information (hereinafter Customer), have agreed upon next conditions.


1. General terms and conditions

1.1 In addition to these terms and conditions, the legal relationships arising from purchasing of the Products from the E-store shall also be governed by the acts of law applicable in the Republic of Estonia.

1.2 Seller shall have the right to make changes at any time in E-shop’s terms and conditions and prices.

1.3 It is required for Customer to review Terms and Conditions.

1.4 During checkout Customer confirms to have read, understood and agrees with these terms and conditions by ticking the “I agree to these Terms and Conditions” checkbox.

1.5 Sales contract between Customer and Seller takes effect after arrival of payment to Sellers bank account. Product will be shipped within 3 workdays after sales contract takes effect.

1.6 If the payment does not arrive within 5 workdays after placing the order, Lace by CR OÜ reserves the right to cancel the order.


2. Placing the order

2.1  Stock shown at E-Shop might  differentiate from actual stock.

2.2 Some of the products are made to order, which means 2-4 week waiting period.

2.3  If the Product is out of stock and the order cannot be shipped, Seller will contact Customer within 3 workdays. In case Customer does not agree with appropriate replacement or new shipping date, Customer will be refunded within 30 days after agreement.

2.4 Customer adds a Product to Cart by clicking the button “Add to Cart”.

2.5 To place an order, Customer should click on “Checkout” button in the Cart sub-menu.

2.6 After filling out required client information and confirming its validity, Client places an order by clicking “Place order”.

2.7 Customer pays for Product immediately after placing an order by bank-link and confirms the payment for Seller by clicking the “Back to Merchant” button.

2.8 After payment for the order E-Shop will send the Customer an e-mail to confirm it.

2.9 Customer takes all responsibility for entering the correct, valid information. Seller does not take any responsibility for not fulfilling the order caused by incorrect information entered by Customer.


3. Payment methods

3.1 Payments are possible via Estonian bank-links (Swedbank, SEB, Nordea, Danske, LHV, Krediidipank) and credit card payments (Visa, Mastercard, Pocopay).

3.2 All payments are made outside of E-Shop in secured environment by payment provider Maksekeskus AS.

3.3 Seller does not have access to Customers bank or credit card data.


4. Prices

4.1 All prices shown at E-Shop are in euros (€). Seller reserves the right to change prices without notice.

4.2 If Seller has changed a price at E-Shop after Customer has placed an order and paid for it the Product will be shipped at a price shown at the moment of order. Customer does not have the right to demand the compensation for difference.

4.3 For orders with a total less than 65 euros, the cost of shipping will also be added according to chosen shipping method.


5. Products

5.1 Photos of Products are illustrative and may unintentionally differ from the actual Products look.


6. Delivery

6.1 Customer has the right to choose between different methods of shipping.

6.2 Orders shipped by Itella Smartpost 2.99€ will arrive to parcel terminal within 5 workdays after the payment has arrived. To get your order delivered to Smartpost parcel terminal choose suitable town and parcel terminal location. When shipment arrives Customer will get a notice via SMS. Shipment will be held in parcel terminal for 7 days.

6.3 Orders shipped by Omniva 2.99€ will arrive to parcel terminal within 5 workdays after the payment has arrived. To get your order delivered to Omniva parcel terminal choose suitable town and parcel terminal location. When shipment arrives Customer will get a notice via SMS. Shipment will be held in parcel terminal for 7 days.

6.4 Customer is required to keep SMS notice mentioned in 6.2 and 6.3 for 14 day return period. Customer can return or replace the Product by using the return code from SMS.

6.5 Orders shipped via Omniva Courier 4.95€ will be delivered to Customers address at agreed upon time. Package will arrive next day after being shipped (1-3 workdays after cleared payment).

6.6 International Registered Maxi Letter to Europe 9-13€ will arrive to Customer in 10 workdays after the payment arrives. Seller will send Customer a tracking code to track the shipment. If the shipment has not arrived in 3 weeks, Customer takes responsibility to contact local post office. Customer will receive the shipment for signature according to the terms of destination country.

6.7 International Registered Maxi Letter to rest of the world 11-17€ will arrive to Customer in 15 workdays after the payment has arrived. Seller will send Customer a tracking code to track the shipment. If shipment has not arrived in 4 weeks, Customer takes responsibility to contact local post office. Customer will receive the shipment for signature according to the terms of destination country.

6.8 If Customer does not retrieve the Product from local post office in time the Customer will pay any fees related to reshipment.

6.9 If Customer has placed an order on weekend (Friday after 15:00 to Monday 12:00) or on national holiday, the 5 workday deadline will start on next workday after the weekend or national holiday at 12:00.


7. Returning and Replacing a Product

7.1 Products ordered via E-Shop can be returned within 14 days. Products that are made to order cannot be returned.

7.2 Returning Product is only acceptable if it is in original package and has no signs of use.

7.3 Packages that are shipped via Itella Smartpost or Omniva parcel terminals can be returned for free by using code from SMS.

7.4 When returning a Product, the money will be refunded in 30 days from the date of contracts termination.

7.5  Refund will be sent to the same bank account from which it was received by Customer.


8. Responsibility

8.1 Seller and Customer are responsible for acting according to laws and acts of Republic of Estonia.

8.2 Seller is responsible for the amount of Products price.
8.3 Customer is responsible for using the service of E-Shop for purposes that are inline with laws and good intentions.


9. Handling of Complaints

9.1 In case of defective Product the Customer has a right to report a complaint to Seller in 2 years from the date of receiving the Product. Complaint must be reported immediately, but not later than 2 months after the discover of defect. In order to resolve the problems, Seller should preserve the proof of purchase (Invoice, contract, etc.) in order to prove that the Product was purchased from Lace By CR E-Shop. Without the proof of purchase Seller has the right to not resolve the problem.

9.2 All complaints will be reviewed and Customer will be contacted on first opportunity, but not later than 15 days after receiving the complaint report.

9.3 The date for reporting complains starts from the date of purchasing the Product.

9.4 Expertise will be performed by Lace By CR OÜ or the manufacturer of the Product to discover the existence and cause of the defect.

9.5 Complaint will not be satisfied if Lace By CR OÜ will prove that defect was caused by Customer.

9.6 If the complaint is about a Product that is out of production, Lace By CR OÜ reserves the right to replace the Product with an equivalent Product

9.7 Customer has the right to request a compensation, termination of contract and refund for the Product if Seller can not correct the Product, correction of a Product fails or Seller fails to correct the Product in timely manner.


10. Policy of Privacy

10.1 By using the services of Lace By CR E-Shop, the Customer gives clear and conscious agreement to handling the personal information on terms stated in given contract.

10.2 Personal information provided by Customer is used to provide the Customer services and merchandise.

10.3 Personal information that is required to ship the Product by courier service will be provided only in required extent.

10.4 Seller can use the personal information provided by Customer to promote information about special offers and campaigns only if the Customer has given agreement for it.

10.5 Handling of personal data is encrypted, which guarantees the safety of personal information and banking information. Payment is made outside of E-Shop environment, handled by corresponding bank or service providers secure payment environment. E-Shop has no access to Customers bank or credit card information.

10.6 Seller takes responsibility to not give out any registered personal information to third-parties.

10.7 Personal information is handled by Lace By CR OÜ (14110927, Raemetsa 1, Reiu küla, Tahkuranna vald, 86508).


11. Provisions

11.1 Arising issues that are not mentioned in given contract will be handled according to the laws of Republic of Estonia.

11.2 Disputes between Seller and Customer are handled by negotiating.

11.3 Any complaints Customer has about E-Shop can be sent by e-mail to info@lacebycr.com

11.4 In case of not reaching agreement, Customer has the right to turn to Consumer Agency.
